Domain Name Registration Scam

Posted in My Blog, Spam by Elliott Back on October 7th, 2008.

I just received an interesting email, which “offers” to help me secure my .com domain name in the Chinese varieties .cn and .hk. It’s more of a threatening piece of spam, because it carries the fear that if I do not avail myself of their services, them or another company will steal my brand!

    Hello!

Thanks for your prompt reply. Domain names were open to be registered all over the world. Now, the aforementioned third party is applying the following domain names and internet keyword:

    Domain names as below:

Once you would like to protect or preserve them by registering ahead due to importance, one valid application form will be sent to start your prior registration. Or we are going to approve the application from the third party if your company does not lay claim to these domains. Please let us know if there is anything more we might be of assistance. Thanks very much and your early reply will be appreciated.

I rang and spoke to her but it was very hard to understand her. I thought she was threatening to give away our domain names so went ahead and ordered the domain names myself through our web server in the US and another Asian registry - one that I could actually read the website. It cost me a small fortune.

This morning I wake to another threatening email - this time because I registered the domains through other companies and not their own. Now they are threatening to give away our Internet Trademark.

I wish I had found this site earlier, although, as I mentioned in my previous post, I now have the domain registrations and I feel good that I registered them through my own sources and didn’t have the scammers do it. If you are concerned about your Trademark then I strongly suggest you view the World Intellectual Property Organization website http://www.wipo.int/about-wipo/en/what/. The idea is that you register your trademark in numerous countries (though not all) through one source. You must have a trademark registered in your own country first and then you can apply to all or some of the countries signed up to WIPO. China is one of the countries. If you select all the countries it is extremely expensive to register so it depends how much value you place on your trademark and how financial your company is. If you select a few countries the cost is reasonable. A calculator is provided to determine the cost (prices are in Swiss Francs). It is a very thorough and helpful website.

This is definitely a scam. I called the phone number in Hong Kong and it didn't work. And since I had emailed them back, they are now repeatedly emailing me. This morning I had two more:

    >>Hello!

I’m sorry, but these domain names and internet keyword had been kept for you company for a long time, we haven’t received your application form until now. We are wondering whether you still need these domain names. If you still need to register them, please send us your application form; if you do not need them then we will confirm the original applicant officially.

    Please advice.

    Best Regards

    Dear Principal,

We are Govdm information technology Ltd, which is the domain name register center in China.I have something need to confirm with you.
we have received an application formally, one company named “Kasem Investment Corp” applies for the domain names

    (foreverinloveweddings.cn
    foreverinloveweddings.com
foreverinloveweddings.com.cn ) and the Internet Trademark(Foreverinloveweddings)on the internet Sep 8, 2008. We need to know the opinion of your company, because the domain names and keywords may relate to the usufruct of brand name on internet.
we would like to get the affirmation of your company, lease contact us by telephone or email as soon as possible. Please let someone in your company who is responsible for trademark or intellectual right contact me freely.

    Best Regards,
    Simon

    ———————————————-

Thanks for your timely reply,During the auditing process, We knew you have registered the domain name “Foreverinloveweddings ” and own the intellectual property,So we e-mail to you for confirming that whether you have consigned Kasem Investment Corp to register these domain names. according to your mail, you don't know them, well then, According to our working experience, there are 2 possibilities:
    1. Kasem Investment Corp is a domain name investment company, they want to register these names before you and sell back to you to gain profits.
    2. It may be a commercial method, Kasem Investment Corp is consigned by your competitor to register, make your clients confused.

According to international domain name registration principle, the domain name is takes open in the world, who register the domain name first, who will be the owner.I think you must know some cases about the domain names grabbed by the others or the third party, and also frequently happens internationally.

To avoid such things from happening. Government request us to audit and record the application during the process of registration. If the original owner company of the domain names have no objection for the registration, we could register the domain names for the Kasem Investment Corp. So we informed you this case and want to get your decision.

Pls consider it in relation to your company status, your future development and so forth.Hope you can give me your decision asap. so that we can handle the next step.

    Best Regard,
    Simon Gao

    Dear Sarah,

I am very sorry. Because there are so many dispute matters recently, which leads to the fact that I haven't dealed with this matter well .Hope you can understand.

I sent you an email form a few days ago, and i just want to help you to dispute this these dmain names. however, i still have not received your feedback. does it mean that you will give up to protect these dmain names? so can you tell me?
because the dispute time is over, we have to make a record. today that Kasem company applied for the registration again.we want to help you but we don't get your application contract, So we cannot help you to protect these dmain names, hope you can understand it.

You should know for the time differences,we can't comminicate with each other well. so I hope both of us can take some time to deal with this matter carefuly.

    Best Regard,
    Simon Gao

    ———————————————-

I am simon, I apologize for the delay,

Thanks for your reply,We knew you have registered the domain name “com.au” and own the intellectual property / own the trademark “Foreverinloveweddings “, this is why we informed you. But now Kasem Investment Corp wanted to apply for other domain names and Internet Trademark you have not registered yet.

You must know Domain name takes open registration, this is international domain name registration principle. So Kasem Investment Corp has right to register them. As a domain name registrar, we have no right to dispute their application. So required by China government to inform your company to protect your interest. But as the company whose trademarks relate to the applied domains, you will get the priority to register these domain names.

Of course, each company has their own idea. If you don't think their application will affect your company, you can give up, we will finish their registration. But if you think these domain names are useful for your company, we can send an application form to you and help you register these within dispute period. This is the only way to prevent domain name grab. Pls let us know your decision soon, so that we can handle the next step.

    Best Regard,
    Simon Gao

    Dear CEO&Principal,

We are a professional Internet consultant organization in Asia, which mainly deal with the global companies' domain name registration and internet intellectual property right protection. Currently, we have a pretty important issue needing to confirm with your company.

On Nov 19, 2008, we received an application formally, one company named “Honour Holdings Ltd.” wanted to applied for the Internet brand “genopro” and some domain names through our body.

During our preliminary investigation, we found that these domain names' keyword and internet brand is identical with your trademark. I wonder whether you consigned Honour International Holdings Ltd to register these domain names through us or not? Or is Honour Holdings Ltd your business partner or distributor in Asia? Currently, we have postponed this application of this company temporarily already. In order to deal with this issue better, please let the principal make a confirmation with me by telephone or email ASAP.

Subject: Re: RE: About ” genopro” intellectual property rights
    Importance: High

    Dear Dan Morin ,

Thank you for your reply and cooperation. We knew your company has registered the domain name “genopro.com” and own the intellectual property, this is why we informed you. But now Honour company do not want to register your trademark or domain name “genopro.com”, they wanted to apply for other domain names and internet brand you have not registered yet.

Following are all the domain names and internet brand which are submitted by Honour company:
    1. Domain name;
    genopro.asia
    genopro.hk
    genopro.tw
    genopro.kr
    genopro.it
    genopro.us
    genopro.sg
    2. Internet brand
    Genopro

If you have no relationship with them. According to our working experience, there are 2 possibilities:1.Honour company is a domain name investment company, they want to register these names before you and sell back to you to gain profits;2.It may be a commercial method, Honour company is consigned by your competitor to register, they are trying to replicate your idea and let your customers feel confusion.

Because domain name takes open registration, this is international domain name registration principle. So Honour company has right to register it. As a domain name registrar, we have no right to stop their application.I think you must know some cases about the domain names grabbed by the third party,we also won't want to see similar things happen.

As the owner of “genopro.com”, your company gets the priority to register these domain names. If you think these domian names are important to your company,we can send you a dispute application form and help you to register these domains within dispute period, this is the way to prevent domain name from grabbing. Of course,if you don't think their application will affect you, you can give up.Each company has its own thinking, hope you consider it in relation to your company status and so forth, then make a decision so that we can conduct the next step work.If you have any questions, please contact me ASAP.

We got one of these, newly updated it seems.

Here's what I think they are doing. Domain kiting.

They are going in and reserving names, “holding” these domain names hoping you will panic, then when you go try to register the domains, they are “taken” (by the scammers of course) who can hold the domains for up to five days without having to pay for them. They then try to extort you for more money to act as the mediator between you and the fictitious entity that supposedly bought your domain names.

Thanks for posting this info so I didn’t waste time worrying that the right to hold my domain name was being challenged.

Following the example of Ken Stone above, I replied with a strongly worded email which, along with those to a couple of alternative addresses, bounced back from the DNS of china-netcom.com. Why do they even bother sending these messages if they can’t receive a response?

Think I’ve answered my own question. Back in the early days of spam, I recall companies like this selling lists of email addresses to poor schmucks who thought they’d make money by doing mass mailouts. Seems China’s taken a while to catch up, but it’s probably your average Chinese internet newbie who’s being scammed here, rather than the people like us they target.

  66. Big MIke says:

PEOPLE…the fact is the company sending these emails out to you is a legitimate Internet Service Provider in China and is doing what it can to make more money LEGITIMATELY! That’s right! This is not a scam that doesn’t deliver on what it promises. If you are stupid enough (unless you are conducting business in China) to register your domain name with them, I guarantee you will have a URL registered to you in Chine that will have either .cn or .hk suffix. You may never use the names but you will possess the right to get hosting for those URL’s as they would be yours.

“Scam” is a bit of a strong word…I mean, it’s a “scam” in that there is really no urgency and you are not likely a typical customer but clearly, there are enough stupid people in the world to warrant their effort. Good for everyone here on doing their homework and not getting all riled up over this email “offer/scam”.

Of course its a scam. They are lying that another party is interested in purchasing domains similar to ours. Their tactic is interesting though, since they make us feel that our domain names are special, but believe me, they’re not.
